The petitioner seeks bail in connection with Baikunthpur P.S. Case No. 253 of 2018 instituted for the offence under Section(s) 414 of the Indian Penal Code and Sections 25(1-b)a/26/35 of the Arms Act.
It is alleged that four persons on two motorcycles were moving in suspicious condition. The police in course of search apprehended three of them and one person managed to run away taking advantage of darkness. It is further alleged that one country made loaded rifle and one live cartridge has been recovered from possession of apprehended person, namely, Amrendra Singh.
It is mentioned in the written report that there is no
Patna High Court Cr.Misc. No.79810 of 2018(2) dt.16-01-2019 2/2 recovery of any incriminating article from possession of this petitioner.
The petitioner is in custody since 28.9.2018. Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Gopalganj in connection with Baikunthpur P.S. Case No. 253 of 2018, subject to the condition that both the bailers shall be the close relative of the petitioner.
