ANJANA MISHRA ORAL ORDER 07-10-2015 Heard learned counsel for the petitioner and learned counsel for the Opposite Party No. 2.

The petitioner apprehends his arrest in connection with Complaint Case No. 490 of 2013 registered for the offences punishable under Sections 323, 379, 498(A) and 504 of the Indian Penal Code.

Learned counsel for the opposite party no. 2 submits that due to paucity of funds, she is unable to attend the court today. However, she is willing and ready to appear in the Court below so that, if at all feasible, some reconciliation proceeding may institute there and the differences between the parties may be resolved in the Court below itself.

Patna High Court Cr.Misc. No.19245 of 2015 (6) dt.07-10-2015 Learned counsel for the petitioner submits that petitioner is always willing and ready to keep his wife with full honour and dignity. The petitioner is present in Court today. Considering the aforesaid submissions, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Madhubani in connection with Complaint Case No. 490 of 2013. However, it is directed that if the petitioner so appear in the Court below, the learned court below may fix a date for appearance of the opposite party no. 2 so that the issue at hand may be resolved at the earliest.
