The petitioner is in custody in connection with Kudhani (Turki O.P.) P.S. Case No. 183 of 2015 for the offences under Sections 328, 304(B)/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has no criminal antecedents and he is in custody since 31.10.2018.

The Trial Court has held out that the mother and the husband of the deceased are innocent and they have been acquitted in the case. The present petitioner has been held out to be the innocent. The discussion of the Trial Court would indicate that the allegation itself is unsustainable. In the aforesaid circumstance, the Court is constrained

Patna High Court Cr.Misc. No.80590 of 2018(2) dt.16-01-2019 2/2 to allow bail to the present petitioner.

Considering the aforesaid, the Court is inclined to grant bail to the petitioner, let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Sub Divisional Judicial Magistrate (West) at Muzaffarpur in connection with Kudhani (Turki O.P.) P.S. Case No. 183 of 2015.
