The appellants are apprehending their arrest in connection with Sitamarhi SC/ST P.S.Case No.39 of 2013 dated 3.11.2013 , registered for offences punishable under Sections 341, 323, 504, 34 of the Indian Penal Code and Section 3(1)(x) of SC/ST (Prevention of Atrocities) Act.

Allegation against the appellants and other accused persons is that while the informant was coming , as he had gone to the office of M/S Rajendra Singh and others for his wages, he saw the appellant and others armed with Lnife, Bhala, Danda and Rod and they assaulted to one Sanjeev Singh causing injury to him and when he went to save him and caught hold to the knife, appellants started assaulting him and also abused by caste name.

APP (SJ) No.1337 of 2019 dt.05-04-2019 2/2 Submission of the learned counsel for the appellants is that though it is alleged that Sanjeev Singh was also assaulted but no case has been lodged by Sanjeev Singh and the present case has been lodged by this appellant in order to make the case serious at the instance of Sanjeev Singh and the police after investigation has submitted final form but the cognizance has been taken in December, 2016. Heard learned Spl.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the appellants, above named, surrender before the court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered and disposed of if possible on the same day.
