This application is filed for grant of regular bail in connection with Bikram P.S. Case No. 57 of 2023 registered under section 364A, 386/34 on the Indian Penal Code Prosecution story in short is that the uncle of the Informant( Raushan Kumar) was in his shop with his younger son. It is alleged that 5 to 6 person came with Scorpio and abducted his uncle and after sometime they called up and demanded amount of Rs. 80.000/- alleging that they are Officials from Excise Department.
Learned A.P.P. has vehemently opposed the prayer for
Patna High Court CR. MISC. No.24175 of 2023(2) dt.18-05-2023 2/2 bail.
Considering the period of custody (i.e. 04.02.2023) and the nature of allegations levelled against the petitioner, this application for regular bail is allowed.
Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet and on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Danapur in connection with Bikram P.S. Case No. 57 of 2023.
The petitioner will visit Bikram police station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
