2. The present writ petition has been filed by the petitioner with the following reliefs:

"i. For that the petitioner has filed a writ in the nature of mandamus directing/ commanding the respondents authorities to consider the case for compassionate appointment in pursuant of the resolution issued by the personnel and Administrative Reforms Department

Patna High Court CWJC No.6408 of 2026 dt.27-04-2026 2/3 Government of Bihar issued Resolution vide memo no 3/c 2-2067/90 ka 13293/patna -15,dt -5 Oct, 1991, as father of the petitioner died in service on 01.02.2024 in the office of Respondent no 5. the application of the petitioner is still pending for consideration for appointment on compassionate ground before the respondent authorities.

ii. For that, the respondent authorities be directed to consider the case for appointment on compassionate grounds, inasmuch as, due to the sudden demise of the sole breadwinner, the family of the deceased employee is facing grave financial hardship.

iii. For any other relief or reliefs for which the petitioner is entitled may be granted by this Hon'ble court."

3. Learned counsel for the petitioner submits that father of the petitioner died during service on 01.02.2024 and petitioner being unmarried daughter has filed application for compassionate appointment, but till date no decision has been taken on her representation.

4. Learned counsel for the State, on the other hand, submits that counter affidavit has not come. He submits that this case may be disposed off directing the District Magistrate, Jehanabad to pass order in accordance with law within specified

Patna High Court CWJC No.6408 of 2026 dt.27-04-2026 3/3 period of time as representation is pending before the District Magistrate, Jehanabad.

In the light of the submissions made, this Court, without entering into the merits or demerits of the case, disposes of the present writ petition with a direction to Respondent No. 2, the District Magistrate, Jehanabad, to consider and decide the representation of the petitioner by passing a reasoned and speaking order within a period of 90 days from the date of receipt/production of a copy of this order. The District Magistrate shall also examine whether the petitioner is entitled to compassionate appointment in accordance with law and pass an appropriate order on that aspect also.
