2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 147, 149, 341, 323, 324, 307, 379, 447, 504, 506 and 302 of the Indian Penal Code.

3. Petitioner is said to have assaulted the father of the informant by Paghariya on his head causing injury and after 13 days of occurrence, he died.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that after completion of investigation, the investigating officer has not found sufficient and incriminating evidence and has submitted the final form against the petitioner

Patna High Court CR. MISC. No.24358 of 2023(3) dt.08-08-2023 2/2 but the learned court below has taken cognizance against him. He further submits that petitioner has no criminal antecedent as stated in para-3 of this application.

5. Learned APP for the State and learned counsel for the informant opposing the prayer for bail submit that there is specific overt act against the petitioner.

6. Considering the facts and circumstances of the case, let the above named petitioner in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Mohiuddin Nagar P.S. Case No. 106 of 2020, subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
