JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 15-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Muffasil (Lakhaura) P.S. Case No. 722 of 2018 for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 17.11.2018. He further submits that in the instant case total 43.200 litres of Nepali liquor was recovered from the bag kept on motorcycle.

Considering the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/-

Patna High Court Cr.Misc. No.80518 of 2018(2) dt.15-01-2019 2/2 (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, East Champaran, Motihari in connection with Muffasil (Lakhaura) P.S. Case No. 722 of 2018.
