Petitioner, who is in custody, seeks bail in connection with Cheriya Bariyarpur P.S. Case No. 184 of 2016, registered for the offences punishable under Section 392 of the Indian Penal Code.

Allegation against petitioner and other co-accused of this case is that after sun set on the point of pistol looted the motorcycle of the informant and informant has identified the accused in the light of motorcycle. Petitioner is named in the F.I.R.

It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been

Patna High Court CR. MISC. No.80383 of 2018(3) dt.14-03-2019 2/2 falsely implicated in this case. The vehicle was not recovered from the possession of the petitioner rather the same has been recovered from possession of one Mantosh Kumar. Petitioner is in custody since 28.08.2018.

Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is hereby rejected.

However, after completing one year of the custody, the petitioner would be at liberty to renew his prayer for grant of bail.
