JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-04-2019 The petitioner apprehends his arrest in connection with Patahi P.S.Case No. 191 of 2017 registered under Sections 1021,121A, and 120B of the Indian penal Code and 25(1-b), a, 25(1-AA), 25(1-AAA), 26 and 35 of the Arms Act, 3 and 4 of the Explosive Substance Act and 16,18, 18A, 18B, 19 and 20 of the Unlawful activities (Prevention) Act, 1967. Allegation as per FIR is that the police on getting information that a secret meeting of Maowadi was being held in the garden of Parsauni Kapur village, raided there and seeing the police, miscreants started fleeing away. However, three miscreants were arrested and arms and ammunition, notes, parchas and several other articles were recovered from them and petitioner was named by the arrested accused persons in their confessional statement.
Patna High Court CR. MISC. No.80422 of 2018(3) dt.15-04-2019 2/2 Submission of learned counsel for the petitioner is that except confessional statement, there is absolutely nothing against him and there is no recovery. Furthermore, he has no criminal antecedent and petitioner is a P.D.S.Dealer also. Heard learned APP also.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to him rather he should surrender within a period of six weeks from the date of receipt of a copy of this order and make prayer for regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order, if possible, on the same day.
