ANJANA PRAKASH ORAL ORDER 07-10-2015 The petitioner was granted anticipatory bail by order dated 22.01.2015 in Cr. Misc. No. 3049 of 2015 but on condition that an affidavit would be filed on behalf of the petitioner that he has fair antecedent. There was one another case pending against him, he could not file such an affidavit and could not avail the benefit of order granting bail.

Considering that the second anticipatory bail is not maintainable, the application is disposed off with direction to the petitioner to surrender before the Court below which shall consider that the petitioner was found fit to be released on bail on merit.
