Mr.Murli Dhar ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-06-2023 Heard learned counsel for the petitioners and the State.
Petitioners apprehend arrest in a case registered for the offence punishable under sections 307/34 and other ancillary sections of the Indian Penal Code and section 27 of the Arms Act.
As per the prosecution case, all the FIR named accused persons including these petitioners, armed with various
Patna High Court CR. MISC. No.23981 of 2023(2) dt.27-06-2023 2/3 weapons, came to the doors of the informant and started fixing Naad and Khuta which was protested by the informant. Thereafter, on the order of petitioner no.3 and 5, co-accused Chandan Singh and Prakash Singh, assaulted informant's son and nephew. Co-accused Prakash Singh assaulted with tangi on the head of the brother of the informant, co-accused Chandan Singh made firing on the informant which missed the target. Learned counsel appearing for the petitioners submits that the specific allegation of assault is against co-accused Prakash Singh and Chandan Singh and there is general allegation of assault against the petitioners and no specific overt act has been alleged against them. Doctor has found simple injuries. Case and counter case. Mufassil Police Station Case No. 157 of 2022 filed by the petitioner no.4 against informant side is of earlier point of time. Petitioners claim clean antecedent.
Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within six weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial
