The petitioner seeks bail in Chainpur P.S. case No. 228 of 2015 registered under Section 409, 419, 420 of the IPC. The petitioner was posted as Sub Postmaster at Chainpur Sub-post office from the year 2013. There was illegal withdrawal of Rs. 32 lakh from the account of MANREGA of different persons.
It is submitted that petitioner was granted bail vide order dated 24.03.2017 passed in Cr. Misc. No. 43420 of 2016 on condition that petitioner would deposit Rs. 13, 50,000/- within four months. It is submitted that petitioner could not deposit Rs. 13,50,000/- within four months and he could be able to deposit only Rs. 63,000/-. Patna High Court CR. MISC. No.1113 of 2019(4) dt.19-06-2019 2/2 was taken into custody on 04.09.2018 and since then the petitioner is in custody. The petitioner has already remained in jail for more than nine months. It is submitted that petitioner is ready to deposit the remaining amount within nine months. Taking into consideration the facts aforesaid and the fact that petitioner has already remained in jail for more than nine months the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Kaimur at Bhabua in connection with Chainpur P.S. case No. 228 of 2015 subject to condition that petitioner shall deposit the remaining amount within nine months failing which the bail bonds of the petitioner shall be cancelled by the court below.
