JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-04-2019 The petitioner apprehends his arrest in connection with Mahila P.S.Case No. 05 of 2019 registered under Sections 376/34 of the Indian penal Code and 3 and 4 of the Dowry Prohibition Act.

Allegation against the petitioner is of kidnapping the daughter of the informant and committed rape with her on the pretext of marriage and thereafter demanded Rs. 2 lacs for the marriage.

Submission of learned counsel for the petitioner is that statement of girl recorded under Section 164 Cr.P.C. itself shows that she has married with the petitioner and report of the Medical Board shows that she is major and as such no allegation

Patna High Court CR. MISC. No.22265 of 2019(2) dt.11-04-2019 2/2 of Section 376 Indian Penal Code is attributed. From the statement of girl it also appears that demand of Rs. 2 lacs was made by the father and mother of the petitioner and not by the petitioner.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Nalanda in connection with Mahila P.S. Case No. 05 of 2019; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
