JUSTICE ARUN KUMAR ORAL ORDER 10-07-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner apprehends his arrest in connection with Bihpur (Jhandapur) P.S. Case No.288 of 2016 registered under Sections 341, 323, 308 and 504/34 of the Indian Penal Code. Allegation is that the petitioner assaulted repeatedly over the head of the informant with iron rod. Learned counsel for the petitioner submits that due to land dispute both sides quarreled, earlier case was lodged by the petitioner's father against the informant's side and during scuffle the informant fell down on hard surface and sustained simple injury over the head and on shoulder and the petitioner has got no criminal antecedent.

Having considered the said facts and circumstances,

Patna High Court Cr.Misc. No.30732 of 2017 (2) dt.10-07-2017 2 / 2 in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let petitioner, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Naugachia, Bhagalpur in connection with Bihpur (Jhandapur) P.S. Case No.288 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
