The Petitioners are apprehending their arrest in Rafiganj P.S. Case No. 62 of 2017 registered for the offence punishable under Sections 147, 149, 342, 323, 324, 337, 307, 504, 506 of the Indian Penal Code.

Learned counsel for the petitioners submit that there has been counter case for the same occurrence due to land dispute in which, petitioners side also sustained injury by hard and blunt substance. It has been further submitted that there is no specific allegation of any assault against the petitioners. The petitioners have got no criminal antecedent.

No.32056 of 2017 (2) dt.13-07-2017 2/2 Considering the aforesaid facts and circumstances of the case, let the petitioners named above in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Rafiganj P.S. Case No. 62 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
