JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Deepnagar P.S. Case No. 401 of 2018, registered for the offences punishable under Sections 307, 342, 379, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner and one Nitish is of firing on the informant and causing injury.

Submission of learned counsel for the petitioner is that though allegation against the petitioner and one Nitish is of firing but only one injury was found on the person of the informant and, that too, is simple in nature and Nitish Yadav has been granted anticipatory bail by the court below vide order dated 1.2.2019 in ABP No. 278 of 2019.

No.22328 of 2019(2) dt.08-04-2019 2/2 Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Deepnagar P.S.Case No. 401 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
