JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-07-2020 In view of the submission and undertaking of the learned Senior counsel for the petitioner, at the time of hearing of this application through Video Conferencing, that he would remove the defect(s), as pointed out by the office vide its notes dated 04.07.2020, within two weeks of starting of the Court proceeding in physical mode, he is permitted to remove the same accordingly. Heard Mr. Yogesh Chandra Verma, learned Senior counsel, assisted by Mr. Rajnish Chandra, learned counsel, appearing for the petitioner, and Mr. Md. Mushtaque Alam, learned A.P.P. for the State, through Video Conferencing.
The petitioner seeks bail in connection with Lakhisarai (Kabaiya) P.S. Case No.254 of 2019 registered under Sections 307, 385 and 387/34 of the Indian Penal Code besides Section 27 of the
Patna High Court CR. MISC. No.21772 of 2020(2) dt.08-07-2020 2/2 Arms Act.
Learned Senior counsel appearing on behalf of the petitioner submits that, earlier, the prayer of the petitioner to grant him the privilege of bail was rejected by this Court vide order dated 09.12.2019 passed in Criminal Misc. No.78175 of 2019 on merit with an observation that the petitioner may renew his prayer for bail after six months, which would appear from Annexure-1 to this application. He further submits that, now, the period of six months has already elapsed from the passing of the aforesaid order dated 09.12.2019 passed in Criminal Misc. No.78175 of 2019 by this Court.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-III, Lakhisarai, in connection with Lakhisarai (Kabaiya) P.S. Case No.254 of 2019 (S.T. No.6 of 2020). (Rajendra Kumar Mishra, J) P.S./- U
