Petitioner seeks bail in connection with Barauni P.S. Case No. 521 of 2018 registered under Sections 307 and 34 of the Indian Penal Code and Section 27 of Arms Act. The report, dated 15.05.2023 received from Additional District and Sessions Judge-III, Begusarai, suggests that the evidence of all the charge-sheet witnesses has been recorded and only the Investigating Officer (I.O) remains to be examined. For examination of the I.O, bailable warrant and non-bailable warrant have been issued.
The petitioner's prayer for bail had earlier been rejected twice on merit on 01.12.2020 passed in Cr. Misc No. 25510 of
Patna High Court CR. MISC. No.25931 of 2023(5) dt.12-07-2023 2/2 2020 and 09.03.2022 passed in Cr. Misc No. 37619 of 2021 respectively.
Having regard to the nature of allegation, the Court, therefore, is not inclined to take a different view. The petitioner's prayer for bail is thus dismissed.
The learned trial court should make all endeavours to conclude the trial expeditiously without granting unnecessary adjournments and undue delay.
Copy of this order be forwarded to the Superintendent of Police, Begusarai to ensure appearance of concerned Investigating Officer without any delay.
