2. The petitioner has preferred this application for grant of regular bail in connection with Ujiarpur P.S. Case No. 322 of 2024 registered for the offences punishable under Sections 303(2) and 334(1) of the BNS.

3. As per the prosecution story, the informant has alleged that on 15.12.2024 he received an information that the lock of the computer room of the school has been broken. When he reached school along with other local people, he found that three locks were broken and several articles were missing.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The allegations made against the petitioner are evidently

The name of the petitioner transpired in this case only on the basis of confessional statement of co-accused namely Shubham Kumar made before the police. No article has been recovered from the possession of the petitioner rather all the stolen articles were recovered from the possession of the other co-accused. The antecedent of the petitioner is clean and he is in custody since 17.12.2024.

5. Learned A.P.P. appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Keeping in view the aforesaid facts and considering the period under custody, let the petitioner, above named, be released on bail after framing of charge on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Dalsingsarai in connection with Ujiarpur P.S. Case No. 322 of 2024 subject to the following conditions :- (i). He will remain physically present on each and every date in the Trial Court till the disposal of this case. (ii).
