This application has been filed for modification of the order dated 16.02.2023 passed in Cr. Misc. No. 44761 of 2022 by which the petitioner had been granted by this Court.

Learned counsel appearing for the petitioner submits that though the petitioner was undertaken to pay Rs. 10,000/- per month to the informant -wife but now he is unable to pay the said amount on the ground that he earns only Rs.9000/- per month. However, he is ready to pay

No.28111 of 2023(2) dt.26-04-2023 2/2 Rs. 3000/- to the informant per month without fail, therefore, considering the monthly income of the petitioner order dated 16.02.2023 passed in Cr. Misc. 44761 of 2022 may be modified by reducing the amount of Rs. 10,000/- to Rs. 3,000/- In view of the above, this Court is not persuaded with the submission advanced on behalf of the petitioner seeking modification of the amount of Rs.10,000/-which was agreed by the petitioner while the prayer for bail of this petitioner was considered.

Accordingly, this modification application is dismissed.
