On the other hand, the counsel for the State submits that he has not received instructions as yet.

Considering the order passed in Criminal Miscellaneous No. 31014 of 2012, the application is allowed and the entire proceeding as against all the accused persons including the order dated 07.06.2012 passed by the Sub Divisional Judicial Magistrate, Kishanganj refusing to discharge the petitioner in Case No. CC105 of 1993 is, hereby, set aside.
