The petitioner, who is in custody since 11.04.2020 and claims to be a person of clean antecedent, seeks bail in connection with Kahalgaon (Ghogha) P.S. Case No. 241 of 2020, dated 12.04.2020, instituted for the offences under Sections 30(a) and 56(d) of the Bihar Prohibition and Excise

Patna High Court CR. MISC. No.21830 of 2020(2) dt.08-07-2020 2/2 Act, 2016.

From the F.I.R., it appears that from the possession of the petitioner 58.500 litres of liquor has been recovered.

It has been submitted on behalf of the petitioner that recovery has wrongly been saddled upon him on mistaken identity.

Regard being had to the period of custody of the petitioner and his clean antecedent, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. Sessions Judge-Cum-Special Judge, Excise, Bhagalpur in connection with Kahalgaon (Ghogha) P.S. Case No. 241 of 2020.

The application stands allowed.
