JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-01-2017 Heard learned counsel for the petitioner as well as learned A.P.P. for the State.
The petitioner prays for anticipatory bail in connection with Basantpur P.S. case no. 40 of 2016 registered for the offence punishable under Sections 363, 366(A)/34 of the Indian Penal Code.
It has been submitted on behalf of petitioner that petitioner is not named in the F.I.R. On perusal of F.I.R., it appears that there is no specific allegation against the petitioner and except the name of petitioner in FIR and C.D., there is nothing against the petitioner. It has also been submitted that as victim girl had married to the brother of the petitioner, he has been implicated in this case.
Patna High Court Cr.Misc. No.37421 of 2016 (4) dt.11-01-2017 2/2 Heard learned A.P.P. also. Learned A.P.P. could not controvert the fact and only submitted that petitioner has also hand in the occurrence though in F.I.R., the allegation is against the brother of the petitioner.
Having heard both sides. In above view of the matter, let the petitioner Raj Kumar Parit @ Raj Kumar Pandit, in the event of his arrest or surrender before the Court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Basantpur P.S. case no. 40 of 2016 subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with a condition that he will cooperate in the trial and make himself available as and when required by the police.
