JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2019 This is an application for grant of anticipatory bail in connection with Hussainganj P.S. Case No. 320 of 2018, disclosing offences under Sections 30(a), 36 and 41(1) of the Bihar Prohibition and Excise Act, 2016.

Prosecution story is that on secret information police raided the place of occurrence and found the persons fleeing away and thereafter, in front of the villagers recovered 74.160 liters of illegal wine from the paddy fields beside the house of the petitioner.

Submission of the learned counsel for the petitioner is that seizure list itself shows that recovery is from the field of Vidya Bhusan and the petitioner has no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner,

Patna High Court CR. MISC. No.22613 of 2019(4) dt.21-06-2019 2/2 above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional District & Sessions Judge,-II-cum-Special Judge Excise, Siwan, in connection with Hussainganj P.S. Case No. 320 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
