JUSTICE SANJAY PRIYA ORAL ORDER 07-07-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Madhoura P.S. Case No. 446 of 2016 corresponding to G.R. No. 6147 of 2016 instituted for the offence under Sections 302/34 of the Indian Penal Code.

As per written report, there is specific allegation against the petitioner of assaulting the father of the informant on his head due to which he sustained injury and became unconscious. He was taken to PMCH for treatment where he died on account of the said injury.

Since there is specific allegation against the petitioner of assaulting the father on account of which he died, this Court is not inclined to grant anticipatory bail to him.

Patna High Court Cr.Misc. No.29738 of 2017 (2) dt.07-07-2017 2/2 Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail which shall be considered by the court below on its own merit without being prejudiced by this order.
