2. The petitioner has preferred this application for grant of regular bail in connection with Azamnagar P.S. Case No. 97 of 2026 dated 03.03.2026 registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
3. As per the allegation, petitioner was apprehended with a motorcycle and from the said motorcycle 100 litres of illicit country-made liquor was recovered.
4. Learned counsel for the petitioner has submitted that petitioner is innocent and has falsely been implicated in this case. It has been submitted that the search and seizure is in
Patna High Court CR. MISC. No.23457 of 2026(3) dt.07-05-2026 2/2 violation of Section 105 of B.N.S.S. It has further been submitted that petitioner is the first offender and he is not the owner of the said vehicle. It has further been submitted that petitioner is in custody since 04.03.2026 having no criminal antecedent.
5. Learned APP for the State has vehemently opposed the prayer for bail of the petitioner.
6. Heard the parties and perused the record.
7. Considering the aforesaid facts and circumstances of the case, the petitioner above-named is directed to be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Katihar, in connection with Azamnagar P.S. Case No. 97 of 2026.
8. The application stands allowed.
