====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 04-11-2020 Heard the parties through virtual court proceeding. The petitioner seeks bail in connection with Sakra P.S. Case No.302 of 2019 registered for the offence punishable under Section 364(A) of the Indian Penal Code. The prosecution story, in brief, is that on 19.06.2019 in the evening at 06.00 p.m., the son of the informant, namely, Ashok Kumar and 35 years went to Budh Market, Muzhaulia but did not return till late night and the informant thereafter started making search of his son. In the morning at 05:30, he received a phone call of his son saying Rakesh Mahto has kidnapped him and is making demand of Rs.10 lakhs. Thereafter, Rakesh Mahto said on that mobile that his son is in his custody and his son will be released on payment of Rs.10 Lakhs.

It has been submitted by learned counsel for the petitioner that the petitioner is in jail custody since 23.01.2020. The petitioner has got six criminal cases mentioned in

Patna High Court CR. MISC. No.24523 of 2020(3) dt.04-11-2020 2/2 paragraph-3 of the bail petition. He further submits that nothing has happened as in the manner alleged rather the fact is that the alleged victim took Rs.10 Lacs from the petitioner as loan and when petitioner put pressure for returning his money, the instant case has been filed by creating a false and concocted story. Learned counsel for the State opposed the bail petition of the petitioner and submits that there is direct allegation against the petitioner for kidnapping the victim. Learned counsel for the petitioner submits that similarly situated co-accused has been granted bail by order dated 16.03.2020 passed in Cr. Misc. No.73897 of 2019 and the charge sheet has been submitted against the petitioner.

In the facts and circumstances of the case, let the above named petitioner be released on bail after framing of charge on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the satisfaction of learned A.C.J.M.4th, Muzaffarpur in connection with Sakra P.S. Case No.302 of 2019.
