The present writ petition has been filed for a direction to respondent No.2, namely, the Collector, Katihar to take a decision on the proposal which is pending before him relating to Bihar Land Reforms (Fixation of Ceiling Area and Acquisition of Surplus Land) Act, 1961 (Bihar Act 12 of 1962) which is Annexure-1.

3. It is submitted by learned counsel for the State that the amendment has been made in the aforesaid law, therefore, only due to this reason, the Collector has kept the matter pending.

4. Having heard learned counsel for the parties, this Court is of the view that under any circumstance, the Collector ought to decide the matter pending before him, in accordance with law.

5. As such, respondent No.2, namely, the Collector, Katihar is directed to take a decision on the proposal of the petitioner in accordance with law and pass the order accordingly within four weeks from the date of production/receipt of a copy of this order.

6. With the aforesaid observation and direction, the writ petition stands disposed of.
