JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-04-2019 Earlier the prayer for bail of the petitioner was dismissed vide order dated 13.12.2018 passed in Cr. Misc. No. 63084 of 2018 and allegation against the petitioner and others is of snatching Rs. 35,000/- from the informant.

Submission of learned counsel for the petitioner is that he has been in judicial custody for 26.08.2018 and other coaccused persons have already been enlarged on bail by the learned court below itself and in this case out of seven witnesses, four have already been examined and they have not supported the case of prosecution.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, at this stage, I am not inclined to enlarge the petitioner on bail, however, learned Trial Court is

Patna High Court CR. MISC. No.23088 of 2019(2) dt.11-04-2019 2/2 directed to conclude the trial within a period of six months and if the trial is not concluded within the aforesaid period, the petitioner will be at liberty to renew his prayer for bail in the learned Trial Court, which will be disposed of by the learned Trial Court on the basis of materials available on record. This application is accordingly dismissed.
