ANJANA MISHRA ORAL ORDER 15-09-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Amarpur P.S. Case No.155 of 2016 for allegedly having committed the offence under Sections 114, 147, 188, 341, 323, 332, 337, 353, 435 and 427 of the Indian Penal Code.
Counsel for the petitioner submits that on the report of the Dy.S.P. (Probation)-cum-S.H.O., Amarpur P.S., the present case has been registered, in which the name of the petitioner has been brought in as a member of the crowd, which has attacked the vehicles and indulged in arson and rioting. It is further submitted that apart from the said
Patna High Court Cr.Misc. No.31021 of 2016 (3) dt.15-09-2016 2/2 allegation, there is no other overt act attributed to the petitioner. It is further submitted that similarly situated three co-accused persons have been extended the privilege of anticipatory bail by a Bench of this Court in Cr.Misc. No.28677 of 2016, vide order dated 26.07.2016. In view of the aforementioned facts and circumstances and that the petitioner is having no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Amarpur P.S. Case No.155 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
