JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-01-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The learned trial court has reported that out of 12 prosecution witnesses only three prosecution witnesses have been examined. However, the learned trial court has sought seven months more time to conclude the trial of the petitioner. Petitioner is said to have given Bhala blow causing injury on the chest of the deceased. The post mortem report has suggested that stab wound was found on the chest of the deceased. Considering the aforesaid facts and circumstances of the case, again I am not inclined to release him on bail, hence, his prayer for bail in connection with Session trial no. 553 of 2016/ 59 of 2017 arising out of Raushanganj P.S.Case No. 57 of 2015, pending in the court of Additional Sessions Judge-II,

Patna High Court Cr.Misc. No.80727 of 2018(3) dt.23-01-2019 2/2 Gaya stands rejected.

However, the learned trial court is directed to expedite the trial of the petitioner and try to conclude the same within the period as mentioned by the trial court in letter no. 31 of 2019 dated 17.01.2019.
