JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-01-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 366, 366(A)/34 of the Indian Penal Code and Section 8 of the Protection of Children from Sexual Offences Act.
The statement of victim has been recorded under Section 164 of the Cr.P.C., which is apparent from the perusal of Anneuxre-3 of this petition. The victim has specifically stated in her statement recorded under Section 164 of the Cr.P.C. that she had gone Rajasthan along with this petitioner by her own sweet will.
Although, the victim appears to be minor but taking

No.187 of 2019(2) dt.17-01-2019 2/2 note of the aforesaid facts as well as this aspect of the matter that the petitioner is languishing in jail custody since 24.07.2018, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Rohtas at Sasaram in connection with POCSO Case No. 61 of 2018 (arising out of Baghaila P.S. Case No. 47 of 2018).
