This application for anticipatory bail arises out of Dinara P.S. Case No. 486 of 2018 for the offence punishable under Sections 147, 148, 149, 341, 337, 342, 307, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act. There is allegation against the persons named in the First Information Report that they were hurling abuses and they had opened fire. There is no allegation, however, in the First

Patna High Court CR. MISC. No.29036 of 2019(2) dt.02-05-2019 2/3 Information Report that any person received any injury. Learned counsel appearing on behalf of the petitioners has submitted that it is evident from the First Information Report that there is land dispute between the informant's family and the petitioners. There are certain other cases lodged against some of the petitioners as has been referred to in paragraph 3 of this application. He has submitted that the said cases have also been lodged at the instance of the same informant out of the same land dispute.

Considering the above submission, this application is allowed.

Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Rohtas in Dinara P.S. Case No. 486 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their
