====================================================== CORAM: HONOURABLE MR. JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 18-01-2019 Heard learned counsel for the petitioner and learned APP for the State.
The petitioner seeks bail in Salimpur P.S. Case No. 79 of 2018 registered under Sections 147, 148, 149, 341, 323, 448, 452, 307 & 504 of the Indian Penal Code.
The petitioner along with five other accused persons are said to have intruded into the house of the informant and petitioner and Faggu Kumar are said to have resorted firing upon left hand and armpit of the father of the informant over a land dispute.
It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. The petitioner has committed no offence. He has no concern with the aforesaid
Patna High Court Cr.Misc. No.79300 of 2018(2) dt.18-01-2019 2/2 occurrence. He has been falsely implicated in this case. There is a case and counter case between the parties over a land dispute. Though there is two lacerated wounds on the left arm and left side of the chest of the victim but the doctor has neither opined about the nature of the weapon used nor the nature of injury and moreover no supplementary injury report has been submitted since the occurrence and the chargesheet in the case has been submitted. The petitioner has been languishing in custody since 01.06.2018.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Barh in connection with Salimpur P.S. Case No.79 of 2018.
