The petitioners apprehend their arrest in Baisi P.S. Case No.250 of 2018 registered under Sections 307, 337, 325 and other minor sections of the Indian Penal Code. The informant Md. Sabbir named the petitioners along with other accused persons and alleged that Md. Manjoor assaulted him with sword on his head. The other accused persons also assaulted him. Meena Khatoon (petitioner no.3) is alleged to have assaulted Saberi (daughter of informant) with lathi on her head.

Learned counsel for the petitioners submits that all the

Patna High Court CR. MISC. No.22230 of 2019(2) dt.08-04-2019 2/2 three petitioners are ladies. There is no allegation of assault against Bibi Sima and Bibi Sayima (petitioner nos.1 and 2). There is allegation against Meena Khatoon (petitioner no.3) that she assaulted Saberi (daughter of informant) by lathi, but the injury on the head of the daughter of informant was opined to be superficial and simple in nature.

Having considered the facts that there is no allegation of assault against Bibi Sima and Bibi Sayima (petitioner nos.1 and 2) and on account of assault made by petitioner no.3 (Meena Khatoon) on the head of the daughter of informant, she got injury which was opined to be superficial and simple in nature, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M.,Purnea in connection with Baisi P.S. Case No.250 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
