JUSTICE SHIVAJI PANDEY ORAL JUDGMENT Date: 20-07-2016 Heard learned counsel for the petitioner and counsel for the State.

The petitioner is claiming benefit of 3rd A.C.P. as he has claimed that the modified A.C.P. Scheme has been enforced with effect from 1.1.2009 whereas the petitioner has superannuated from service on 31.7.2009.

Learned counsel for the petitioner submits that the petitioner has filed his representation dated 18.7.2012 before the District Magistrate cum Collector, Sitamarhi which is pending consideration.

Patna High Court CWJC No.10339 of 2013 dt.20-07-2016 For convenience, the petitioner is directed to file a fresh representation along with a copy of this order before the District Magistrate cum Collector, Sitamarhi who will pass a reasoned order within a period of three months from the date of filing of the fresh representation but, only after giving an opportunity of hearing to the petitioner.

With the aforementioned observation and direction, this application is disposed of.
