The petitioner apprehends his arrest in a case registered for the offences punishable under Section 364/34 of the Indian Penal Code.

All the F.I.R. named accused along with two unknown persons including this petitioner is said to have kidnapped the husband of the informant.

It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. As a matter of fact, the informant and her husband along with her Bhaisur had taken money from one relative of accused in the name of job and provided a job letter

Patna High Court CR. MISC. No.25997 of 2023(3) dt.12-07-2023 2/2 which turned out to be fake one and when co-accused Ganesh Mahto demanded money, the Bhaisur of the informant handed over a cheque in favour of Sonu Kumar, Pushpanjali as well as Rinku Kumari but all got bounced. It is further submitted that wife of one co-accused filed two cases against the husband of the informant and others for cheating and taking money in the name of providing job in the Health Department and to save skin from those cases this false and frivolous case has been lodged against the petitioner and others. Petitioner has no criminal antecedent as mentioned in para-3 of this application.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with L.N.M.U. P.S. Case No.241 of 2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
