JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 03-10-2016 After some argument, the learned counsel appearing on behalf of the petitioner, in presence of the learned AC to AAGX, appearing on behalf of the respondent nos. 1 to 5, seeks permission to withdraw the present writ petition with a liberty to approach the civil court of competent jurisdiction for grant of appropriate relief(s) to the petitioner with respect to the lands in
Patna High Court CWJC No.15437 of 2014 (2) dt.03-10-2016 2/2 question claimed by him.
Permission is accorded.
The writ petition stands dismissed as withdrawn with the liberty aforesaid.
It goes without saying that if the claim of right and title of the petitioner with respect to the lands in question is accepted by the civil court, then he shall be at liberty to file a fresh petition for mutation of his name with respect to the lands in question, which shall be decided in accordance with law keeping in mind the judgment and decree passed by the civil court.
