Mr.Ram Naresh Ray ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 20-02-2019 Heard Mr. Pramod Mishra, learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehend his arrest in Kotwali(Tilkamanjhi) P.S. Case No.841 of 2017 registered under Section 307 and other Sections of the I.P.C. and under Section 27 of the Arms Act.

Learned counsel for the petitioner submits that prayer for anticipatory bail of the petitioner was earlier rejected by order dated 10.04.2018 passed in Cr. Misc. No.17940 of 2018 but the petitioner again filed this petition for grant of anticipatory bail because the petitioner is suffering from Cancer and is under treatment of Dr. Chhangs Super Specialty Hospital but it appears that in spite of order, the petitioner did not

Patna High Court Cr.Misc. No.77858 of 2018(2) dt.20-02-2019 2/2 surrender in the court below. The petitioner was diagnosed suffering from Cancer later on.

Taking into consideration the facts, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.

Let the petitioner surrenders in the court below within four weeks from the date of receipt of this order and on such, learned court below shall consider the prayer for regular bail of the petitioner taking into consideration the fact that the petitioner is suffering from Cancer and dispose of the bail petition preferably on the same day.
