ANJANA MISHRA ORAL ORDER 28-01-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 29.09.2018 in connection with Guthani P.S. Case No. 228 of 2018 registered for the offence under Sections 30(a), 38(i),41(i) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that he is merely a driver and was not aware of any such item being loaded on his vehicle. It is further submitted that he is languishing in custody since 29.09.2018 and he is not having any criminal antecedent.

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand)
