2. The petitioner apprehends his arrest for the offences alleged under Sections 323, 498(A), 494 of the Indian Penal Code registered in connection with Complaint Case No. 516C of 2011.
3. Learned counsel for the Opposite Party No. 2 accepts that payment of Rs. 25,000/- pursuant to the order of this Court dated 20.01.2016 has been received but however no further payments pursuant to the agreement dated 24.09.2011 is being made by the petitioner.
4. Learned counsel for the petitioner undertakes to make a further lump sum payment of Rs. 10,000/- within 15 days from today and assures to make further payments in future. It is further stated that the petitioner has received
Patna High Court Cr.Misc. No.36884 of 2014 (4) dt.13-04-2016 notice on Maintenance case filed by the Opposite Party No. 2 in which the petitioner undertakes to appear.
5. Having regard to the entirety of the facts and circumstances of the case, in the event of the petitioner's arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Complaint Case No. 516C of 2011, subject to the conditions as laid down under Section 438 (2) Cr.P.C. and also subject to the further conditions that the petitioner shall make payment of Rs. 10,000/- to the complainant within a period of 15 days from today out of the amount liable to be paid by him in terms of the aforesaid agreement dated 24.09.2011.
