The petitioner seeks bail in Kachhawan P.S. Case No. 66 of 2018, instituted for the offence under Section(s) 363 and 365 of Indian Penal Code.

It is alleged in the written report that petitioner took the son of the informant on allurement to earn livelihood outside the State. The son of the informant did not return. Counsel for the petitioner submits that petitioner is in custody since 16.11.2018 merely on suspicion. He has clean antecedent. He further submits that there is no eye witness of the occurrence. There is no allegation of any specific overt act against the petitioner.

Keeping in view the period spent by the petitioner

Patna High Court CR. MISC. No.24109 of 2019(6) dt.11-07-2019 2/2 in custody, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge-1st-cum A.C.J.M. Bikramganj, Rohtas, in connection with Kachhawan P.S. Case No. 66 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
