====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 10-01-2022 Heard Shri N.K. Agrawal, learned Senior Counsel for the petitioner and Shri Ravindra Kumar, learned A.P.P. for the State through virtual court proceedings.
Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Hazipur Town P.S. Case No. 397 of 2020 instituted for the offences under Sections 147, 148, 341, 323, 307 and 302 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is in custody since 03.07.2021 and charge-sheet has been submitted in this case and has antecedent of one case. Learned counsel for the petitioner submits that informant in the FIR alleges that on 18.06.2020, when husband

No.32707 of 2021(2) dt.10-01-2022 2/3 of the informant was parking his motorcycle after returning from market, all the accused persons named in the FIR including the petitioner assaulted him by means of lathi and danda due to previous dispute and when the daughter of the informant came to save him, she was also assaulted and further during treatment husband of the informant died. Learned counsel for the petitioner submits that the petitioner is named in the FIR and allegations are general and omnibus in nature. He further submits that similarly situated other co-accused, namely, Raj Ballav Singh has already been allowed bail by a Coordinate Bench of this Court vide order dated 05.03.2021 passed in Cr. Misc. No. 1774 of 2021. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the fact that the petitioner is in custody since 03.07.2021, charge-sheet has been submitted in this case and similarly situated other co-accused has already been allowed bail let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hazipur in connection with Hazipur Town P.S. Case No. 397 of
Patna High Court CR. MISC. No.32707 of 2021(2) dt.10-01-2022 3/3 2020, with condition that one of the bailors shall be the father of the petitioner.
