The petitioner seeks bail in connection with Bypass P.S. Case No.839 of 2023 registered for the offence under Sections 341, 342, 323, 307, 379, 504, 506/34 of the Indian Penal Code.

Allegation against the petitioner along with other co-accused persons is to have assaulted the son of the informant.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner has falsely been implicated in the present case. It is submitted that allegation as regard to assault against this petitioner is general and omnibus

Patna High Court CR. MISC. No.27283 of 2024(2) dt.20-04-2024 2/2 in nature and no specific allegation is against this petitioner. It is submitted that there is delay of 13 days in lodging the FIR, which any plausible reason. It is submitted that it appears from perusal of injury report that victim has four injuries i.e. abrasion 1⁄2 inch long at left cheek, swelling near right eye 1⁄2 inch x 1⁄4 inch, lacerated wound 1⁄2 inch long on back and one swelling 1⁄2 inch x 1⁄2 inch on right left. It is further submitted that petitioner is in custody since 17.12.2023.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances and submissions made on behalf of the petitioner, let the petitioner, above named, is directed to be released on bail in connection with Bypass P.S. Case No.839 of 2023 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya.
