It is stated that during the pendency of the application petitioner no.1 (Champa Devi @ Champi Devi) has been arrested. Her application for grant of anticipatory bail has become infructuous.
Petitioner no. 2 is the brother-in-law (Bhainsur) of the victim. It is stated that the marriage was solemnized between the younger brother of petitioner no.2 about eight years back. The victim died in her Sasural. The matter was reported to the father of the victim. It is contended that it has come in course of investigation that petitioner no. 2 was residing separately. The husband is already in custody.

No.36278 of 2014 (3) dt.03-04-2015 2 / 2 In the facts and circumstances of the case, let petitioner no.2 abovenamed, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in Ekchari P.S. Case No. 16 of 2012 on condition that one of the bailors shall be his own/close family member. In the event of framing of charge the petitioner no.2 shall appear on each date fixed at the trial. In case of non appearance on two consecutive dates the trial court shall cancel his bail bond and secure his arrest in accordance with law.
