JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 13-03-2015 Prayer for anticipatory bail of petitioner no. 2 has become infructuous as he has been arrested.
The petitioners apprehend their arrest in a case instituted under Sections 147,148,149,341,323,307,379 and 504 of the Indian Penal Code.
It appears that on account of land dispute some fight took place between two sides. The accused side has also filed a case under Section 307 of the Indian Penal Code. He submits that three persons on their side have sustained injuries including incise wound. Learned counsel submits that the injury inflicted by petitioner no. 3 are also simple in nature. He further submits that
Patna High Court Cr.Misc. No.37951 of 2014 (2) dt.13-03-2015 2/2 Sarvesh Singh who is accused in a case filed by the accused side and is alleged to have also assaulted with 'garasa' has been allowed anticipatory bail.
Considering the facts of the case, in the event of arrest or surrender before the Court below within four weeks from today, let the petitioners no. 1, 3 and 4 be released on bail upon furnishing bail bonds of Rs. 5000/-(five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada in Sirdala P.S. Case No. 87 of 2014 subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
