JUSTICE SAMARENDRA PRATAP SINGH ORAL JUDGMENT Date: 01-04-2015 According to the petitioner, he is owner of 2 Bighas 15 Kathas of land of Mauza Rahimpur, P.S. and Anchal- Parbatta, District- Khagaria, Tauzi No. 3030, Thana No. 373, appertaining to khata no. 92, plot nos. 197, 100, 196, 198, 101 and 108. He stated that on account of flood in river Ganges, some erosion took place on the banks of the said river and village Temtha Goriyari of Parbatta Anchal of district Khagaria was completely submerged in the river.
2. The petitioner alleges that the Government has settled some of the displaced persons without acquiring his land.
3. The State in the counter affidavit stated that it is entirely correct that the displaced persons were settled on the land of the petitioner. Nonetheless, recommendation were made for acquiring his land (Annexure-A).

4. In view of the counter affidavit, I need not to proceed further with the matter.
