JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-01-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 379, 354-B, 307, 380, 504 and 506 of the Indian Penal Code.
The petitioner is named in the First Information Report and according to prosecution case, at the time of alleged occurrence, he was armed with Bhala.
Submission on behalf of the petitioner is that there is case and counter case between the parties and persons from both the sides sustained injuries. It is further submitted that no Bhala injury was found on the person of any of the injureds of this
Patna High Court Cr.Misc. No.78743 of 2018(2) dt.18-01-2019 2/2 case and, moreover, some co-accused have earlier been granted privilege of anticipatory bail by a co-ordinate Bench of this Court. It is also pointed out all the injureds of this case have sustained simple injury, which is evident from perusal of Anneuxre-3 series of this petition.
Considering the aforesaid facts and circumstances as well as submissions of the parties, Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Barhariya P.S.
