JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-11-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419, 420, 467, 468, 120B of the Indian Penal Code.

The prosecution case is that Commandant, Home Guard submitted a written report on the direction of District Magistrate, Nalanda alleging therein that during selection of Home Guard in the year 2011, in place of 12 bona fide candidates imposter appeared at the physical test. The suspicion was raised against the petitioner since petitioner was also one of the candidates and in the video footage, it appears that in place of petitioner someone other was appearing in the physical test.

It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled. The actual selection has not been made till date and

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Bihar P.S. Case No. 373 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
